Man sentenced to probation

A 22-year-old Tracy, Calif., man was placed on three years probation Monday for indecent exposure for what he said was consensual sex with a 19-year-old woman.

Senior Judge Robert Rose sentenced Juan Flores to one year in Douglas County Jail which he suspended.

"You understand the pain you have caused the victim. You understand what you have done to your family. The next time there will be no leniency by any judge," Rose said.

The victim claimed that Flores assaulted her. She attended the sentencing, but was too distraught to make a statement.

"She is a fine young woman and this has impacted her life severely," said prosecutor Michael McCormick. "She would like to see him spend the rest of his life in prison. That, however, is not before us. She would like to see him incarcerated."

The incident occurred more than a year ago, on July 6, 2006, at Zephyr Cove campgrounds.

Flores' attorney, William Cole, said his client and the young woman both used alcohol and marijuana.

"This is a total tragic event which will have an effect on both people's lives," he said.

The victim admitted she was intoxicated and couldn't remember what happened.

Flores maintained that he did not assault the young woman, but pleaded guilty to the lesser charge to avoid conviction on a more serious offense.

"I really apologize for the situation we're in," Flores said. "It was never my intention to cause any harm. What hurts me most is that my family had to go through this. I was under the assumption that everything was consensual. I apologize to the plaintiff's family for any harm. It will never happen again."
