Dad sentenced in daughter's shooting death

YERINGTON -- A Dayton father was sentenced Monday to prison in connectin with the shooting death of his 2-year-old daughter.

Raymond Marquez, 43, appeared in Lyon County District Court before Judge Robert E. Estes, who sentenced Marquez to 1-4 years for being an ex-felon in possession of a firearm.

Marquez was charged after his daughter Amanda was accidentally shot in the head by her 14-year-old brother Aug. 21.

The family reported to police Amanda was shot in a drive-by shooting. Eventually, however, the family admitted to fabricating the drive-by story to keep the boy out of jail.

Lyon County District Attorney Leon Aberasturi said the family waited at least 20 minutes before calling for help. The mortally wounded toddler died Aug. 24 after spending three days on life support.

An investigation into Raymond Marquez's background revealed he had an alias of Raul Perez and had a felony conviction in Illinois, said Aberasturi. He said Marquez served three years in prison on a robbery charge.

Amanda's mother, Cleotilde Montalbo, was also charged with gross misdemeanor conspiracy to file a false police report. Those charges were eventually dismissed.

Officials determined the shooting was an accident and no charges were ever filed against the 14-year-old.

The shooting took place on Fortune Drive just east of Dayton.
