Probation revoked for Resendiz case

Probation for a 19-year-old Carson City man charged in the 1998 beating death of Sammy Resendiz was revoked Monday.

District Judge Michael Griffin sentenced Michael Kizer to a year in jail after he was stopped by police Nov. 5 for allegedly speeding and weapons were found inside the vehicle.

Kizer, one of 12 defendants initially charged in Resendiz's Aug. 21, 1998, motel-room beating death, pleaded guilty to conspiracy to commit battery in the case and was sentenced to probation.

Rocky Boice, 23, was the only one to go to trial and is serving a sentence of up to 50 years in prison after being found guilty of second degree murder.

Jessica Evans, 24, and Lew Dutchy, 28 , pleaded guilty to charges of principal to commit battery with a deadly weapon and were given prison sentences of two to five years.

The remaining defendants were given probation: Alejandro Avila and David Moyle pleaded guilty to conspiracy to commit battery with a deadly weapon; Fred Fred, 23, pleaded to a charge of battery causing substantial bodily harm; Silvia Fred, 22, pleaded to a charge of gross misdemeanor conspiracy to commit battery with a deadly weapon; Clint Malone, 19, the only defendant to plead guilty to two charges, received 18 months in jail for felony battery with a deadly weapon resulting in substantial bodily harm and gross misdemeanor conspiracy to commit battery. Julian Contreras, 19, Jaron Malone, 22, and Elvin Fred, 21, pleaded guilty to battery with substantial bodily harm and also received probation.
