A Carson City teacher is on paid administrative leave while he awaits a hearing on charges of open and gross lewdness and indecent exposure.
Scott Frank, 26, a Carson Middle School history teacher, will not be in any schools or classrooms in the district when classes begin Tuesday, said Richard Stokes, associate superintendent of human resources for the Carson City School District.
"This particular case right now is being handled by the judicial system. If Mr. Frank is exonerated, that would certainly have to be taken into consideration," he said.
He noted the agreement between Frank and the school district was reached through Frank's attorney.
"We're going to let the judicial system take its course, then we'll re-evaluate where we're at," Stokes said.
Frank was arrested Aug. 1 after a neighbor called police July 29 to allege she could see, from an upstairs window in her home, Frank fondling himself in his backyard while watching his elderly neighbor. The witness told police she allegedly saw Frank, nude from the waist down, approach the fence and call his neighbor over.
The victim also told police when Frank spoke to her, he had no pants on.
According to the arrest report filed by Deputy Ray Guzman, Frank allegedly said he didn't think anyone could see him in his back yard as he sunbathed nude and masturbated.
"Frank stated that he did not realize that someone saw him from upstairs and that he thought it would be an all right time to do it because he thought everyone was gone to work," Guzman wrote.
A hearing to determine if there is enough evidence to go forward with the charges is set for Sept. 3.
If convicted Frank would lose his teaching license and could be subjected to registering as a sex offender.
