A new criminal complaint amending a charge of first-degree murder to second-degree murder will be filed next week against Maximilliano Cisneros.
District Attorney Noel Waters said he expects his office to file the charge Monday to reflect what they know of the shooting death of Juan Carlos Alegria.
Maximilliano Cisneros, 23, is charged in the death of Alegria, 22, March 24 on Eighth Street in west Carson City.
Cisneros was picked up Wednesday in Guadalajara, Mexico near the home of his grandmother on a U.S. warrant for open murder and accessory to murder.
According to court documents, Alegria accompanied friend Fidel Fuentes to his estranged girlfriend's apartment when Fuentes saw Cisneros inside and allegedly broke down the door. Cisneros allegedly emerged from a back room and opened fire hitting Alegria three times in the chest and Fuentes once in the leg. He is believed to have fled the scene with the help of friend Victor Rodriguez.
Rodriguez was arrested in Reno in August and is charged with felony accessory to murder. He is currently out on bail and will appear in court in March.
Attorney William Routsis said his client Rodriguez was not involved in Cisneros' capture Wednesday.
"Through the course of this entire investigation Mr. Rodriguez has refused to speak with law enforcement or the prosecution in this case regarding himself or Mr. Cisneros. My client has never spoken to anybody about the presence or whereabouts of Mr. Cisneros," Routsis said Friday.
Cisneros is being held in the Los Angeles jail. His return to Nevada has not been determined yet, Waters said.
