Minden attorney Jennifer Yturbide has been appointed to represent bank robber Steven Simmons after attorney Charles Zumpft said he won't be able to take the case. Judge Michael Gibbons appointed Zumpft to represent Simmons after the 27-year-old Mammoth Lakes man decided to fire attorney Tod Young.

Yturbide and Zumpft work in the Minden law firm of Brooke, Shaw, Zumpft.

A Topaz Ranch Estates man pleaded not guilty Monday to four felony counts in connection with the alleged battery Dec. 21 of his former girlfriend.

District Judge Michael Gibbons set a March 27 trial date for Terrence Joseph Howell, 51, who has been in Douglas County Jail since the incident.

Howell is charged with battery with intent to kill with a dangerous weapon, battery that constitutes domestic violence with the use of a deadly weapon, assault with a deadly weapon and false imprisonment with use of a deadly weapon.

Howell's lawyer, Arnold Brock of Reno, said its his client's position that the woman is violent and he was acting to protect himself and keep her from harming herself.

Gibbons refused to release Howell on his own recognizance but did modify his $50,000 cash bail to bondable.

Gibbons said if Howell is released, he wants to make sure the suspect stays away from the woman.

The Nevada Department of Wildlife, working with U.S. Fish & Wildlife Service and U.S. Department of Agriculture's Wildlife Services personnel, has completed testing on nearly 2,500 bird samples from around Nevada and found no samples testing positive for avian influenza.
