Judicial proceedings were continued for a week Wednesday for a 38-year-old Gardnerville man who showed up for a drunk driving arraignment with an alcohol level three times the legal limit.
Justice Pro Tem Paul Gilbert found Kevin Leroy in contempt and ordered him to serve five days in jail prior to his Jan. 21 court appearance.
Leroy was about 10 minutes late for his Wednesday hearing and denied he had been drinking.
"I was running late," he told Gilbert.
His lawyer, Tod Young, said he'd met with Leroy earlier Wednesday and he was fine.
Gilbert had Leroy tested and a preliminary breath test revealed a blood-alcohol content of .24, three times the legal limit of .08 for driving in Nevada.
He ordered Leroy jailed immediately, but allowed him to be released at 6 a.m. Thursday for 48 hours so he could report to his job as a Department of Defense firefighter at the Marine Corps Mountain Warfare Training Center in Pickel Meadow.
Gilbert ordered Leroy to return at 8 a.m. Saturday and warned him if he has been drinking or is late, he'll be jailed for a month for contempt.
Leroy was in court following a Nov. 23 arrest in the Gardnerville Ranchos. His blood-alcohol content on that date was reportedly .153.
