District Judge Dave Gamble added Western Regional Drug Court to the deferred sentence of a 35-year-old woman who tested positive for drugs the first time she reported to her probation officer.
Gamble also ordered Nokomis Murin to remain in Douglas County Jail until her first drug court appearance July 20.
"This is the last time that you appear before me on this that I won't put you in prison," Gamble said.
Murin pleaded guilty to possession of a controlled substance, cocaine. In exchange for her plea, the district attorney's office dismissed charges of forgery, grand larceny and embezzlement.
She was given a deferred sentence June 23 and ordered to pay $4,575 restitution as part of three years probation.
When she reported June 25 at Parole and Probation, she used obscenities with her probation officer, then tested positive for marijuana, cocaine and Xanax and was jailed.
Her lawyer, Derrick Lopez, asked Gamble to include drug court in her diversion. If Murin successfully completes the terms, the charge could be dropped.
"I think Ms. Murin has had some time in the last two weeks to think about her attitude. She knows it's her fault," Lopez said.
Murin, who lives in South Lake Tahoe, must remain in Nevada for 90 days before she can be approved for interstate supervision by California officials.
Lopez said she had signed a one-year lease on a residence in South Lake Tahoe.
"How can anybody who has a felony sign a year lease?" Gamble asked. "She's got a lease all right. It's a 12-32-month lease."
