Supplier drops lawsuit against Minden project

A lawsuit filed by a plumbing supplier against a utility contractor working on the Minden Gateway Center is being dropped.

On Thursday, Patrick Prutsman of Ferguson Waterworks said his company was dropping a lawsuit against Greg Hunt of Action Construction Co. and Minden Gateway Center, LLC.

Prutsman said the purpose of the lawsuit was to recoup losses for plumping supplies furnished to the property months ago. The property, the site of a proposed commercial mall, sits near the intersection of highways 395 and 88.

Prutsman said Action Construction Co. is a valuable client that unfortunately was named in the lawsuit as a technicality.

"We have a great relationship with Action," he said. "We are very people-oriented and all about relationships. We're dropping this because of that relationship."

The original suit claimed that Action Construction Co. refused to pay for thousands of dollars worth of plumbing supplies, but Prutsman said that was incorrect.

"They never refused to pay," he said. "We are a team. We use lawyers as a last resort. But we're dropping everything. We feel Greg can handle it more effectively."

Action Construction Co., a utility contractor, is a rung in a ladder of subcontractors leading up to the top. The problem, Prutsman said, really lies with owner/developer Minden Gateway Center, LLC.

"Minden Gateway is hurting a lot of small businesses," he said.

Greg Hunt, president of Action Construction Co., said his company has filed several liens on the property.

"I'm owed a substantial amount of money," he said. "There is a whole group of subcontractors, engineers, construction managers, architects and material suppliers that are owed money. The package is starting to be unwrapped " the mystery of why everything isn't moving."

Since December, more than 20 liens have been filed on the property, including half a dozen by Action. Other parties include RO Anderson Engineering, Titan Electrical Contracting, Bing Materials, Inc., and the Minden-Gardnerville Sanitation District.
