A 42-year-old Johnson Lane helicopter mechanic accused of trading nude videos of a 17-year-old girl in exchange for the use of a car is set to plead guilty June 9 to attempted use of a minor as subject of a sexual portrayal in a performance.
Troy Marvin Creeks waived his right to a preliminary hearing Wednesday in East Fork Justice Court.
His lawyer, Tod Young, said in exchange for Creeks' guilty plea, the prosecution would not ask for more than 10 years in prison.
Young is free to ask for probation for the man who was arrested in December and has been out on $10,000 bail.
"It's not what I want to do, but what I'm going to do," Creeks said of the plea.
He was arrested in mid-December after the girl's mother found a handwritten contract that required the 17-year-old to perform nude in videos in exchange for use of a car.
Young pointed out that if Creeks had sex with the girl, there be no crime.
Young said there was nothing in the probable cause report to indicate the victim was coerced into making the videotape.
Had Creeks been convicted of the original charge, use of a minor as a subject of sexual portrayal in a performance, he would have faced up to life in prison.
