The former manager of Dairy Queen, accused of embezzling more than $27,000, is set to enter a plea Dec. 21 in district court and is to make restitution.
Carl Franklin Wilson Jr., 41, of Gardnerville, waived his preliminary hearing Wednesday in East Fork Justice Court and was ordered to appear Dec. 21 before District Judge Dave Gamble.
He is charged with felony embezzlement.
Wilson is out of custody, but was ordered to stay away from Dairy Queen, and not to discuss the case with any employees.
East Fork Judge Tom Perkins granted attorney Tod Young's request that an electronic monitoring device be removed from his client. The ankle monitor cost Wilson $15 a day.
"The money would be better used toward restitution," Young said. "Mr. Wilson has agreed to make restitution as part of a plea negotiation. It is unlikely that he would flee. He has no prior criminal history."
Perkins warned Wilson if he failed to appear, he would be subject to arrest and incarceration.
"I'll be here, sir," Wilson said.
According to court reports, the alleged embezzlement took place over three months from August through October.
Court reports indicated the missing money has not been recovered. Wilson reportedly told investigators he used the money to pay bills.
