Man seeks diversion on felony DUI charge

A man facing a charge for felony drunk driving is scheduled to appear in Douglas County District Court this morning.

Dan Beliveau, 51, is expected to ask District Judge Dave Gamble to participate in a diversion program this morning, afer he waived his preliminary hearing on Dec. 30. Otherwise, he faces 12-48 months in prison.

Beliveau was arrested Dec. 17 at the Chevron station on Mica Drive and Highway 395. According to court documents, his blood-alcohol content was .222, nearly three times the legal limit of .08 for driving in Nevada.

Beliveau has prior convictions in East Fork Justice Court on Sept. 30, 2004, and Aug. 13, 2008.

A third conviction in less than seven years results in a mandatory prison sentence unless the defendant is accepted for a 3-5-year diversion program for felony drunk drivers.
