A Chimney Rock man sought diversion to avoid prison for a third conviction for driving under the influence.
Sean T. Betz, 45, was arrested July 12, 2009. He had prior convictions in 2003 and 2007.
Under the diversion program, if he completes a 3-5 year intensive counseling program, the conviction will be treated as a misdemeanor DUI. Betz said he'd been sober for the last six months, and that he's already started the counseling required for the program.
"I know I can't drink any more," he said.
