A 30-year-old ex-felon was sentenced Tuesday to five years in Nevada State Prison after his second conviction for possession of a controlled substance for sale.
"This must be getting tiresome to you," District Judge Dave Gamble told Cody Neubauer.
Neubauer is to appear in East Fork Justice Court on Wednesday to answer a charge of failing to register as an ex-felon.
Gamble said Neubauer must serve a minimum of 12 months before he is eligible for parole. He received credit for 104 days in custody. He was ineligible for probation.
He was arrested Feb. 11 on nearly a dozen charges including an accusation he stole evidence from his own vehicle after it was taken to the county impound yard.
The charges were dropped in exchange for his guilty plea.
According to reports, a deputy observed Neubauer Feb. 10 in his vehicle in a liquor store parking lot on Langley Drive. The officer said several subjects were around the driver's window and appeared to be handing Neubauer something. Others appeared to be acting as lookouts.
Substances found during a search of Neubauer's residence and vehicle turned out to be a cutting agent and less than one-tenth of a gram of methamphetamine rather than the three grams of methamphetamine and 38.6 grams of cocaine that officials suspected at the time of Neubauer's arrest.
They also recovered .33 grams of black tar heroin.
"This is a situation where there's a minimal amount of controlled substances in his possession, but because of Mr. Neubauer's history, he has a minimal amount of leverage," said lawyer Tom Perkins, representing the defendant.
Prosecutor Karen Dustman said Neubauer took responsibility for his offense.
"He was upfront even though he has the history he does," Dustman said.
A records check revealed that Neubauer was not registered as an ex-felon despite at least two felony convictions in 2002.
