Man set to enter plea in lewdness case

A 21-year-old Gardnerville man accused of having sex with a 13-year-old girl is set to plead Nov. 29 to one felony charge of lewdness with a child under 14.

In exchange for a guilty plea, the district attorney is to dismiss three felony counts of sexual assault against a child under age 14 against Juan Daniel Martir.

He waived his right to a preliminary hearing Wednesday in East Fork Justice Court.

Martir was arrested Oct. 20 and accused of exposing himself to the girl at her Ruhenstroth home.

The incident was discovered by an adult caretaker with whom the girl lives. The caretaker found Martir, identified as a family friend, exposing himself to the girl in the residence.

Further investigation turned up evidence that Martir had engaged in sexual activity with the girl. Martir reportedly admitted to investigators that he had sex with her and knew she was 13.

The victim said Martir forced himself on her.

He is being held in Douglas County Jail on $202,500.
