No performance clause?

I read with some interest the news that Douglas County is suing the Riverwood Partners to void their contract. I don't understand why they would need to sue them.

Wasn't the $24.7 million subsidy deal ($823 per square foot) written with a performance clause and protections for the taxpayers of Douglas County?

Didn't we learn anything from the Saratoga Springs Estates development deal that allowed higher density housing in exchange for open space in the form of a golf course? The golf course was never built, but the homes certainly were.

It is also sad to see that NDOT just finished a costly upgrade at the intersection that was to service this new shopping center.

We now have our own "bridge to nowhere" that accesses the dust prone 25 acre site. This pad truly is blight.

Perhaps we can use redevelopment money to grow sagebrush and control the dust.
