A hearing was continued until next week for Dawn Oxley, 37, accused of a second charge of domestic battery and a probation violation.
Oxley's lawyer, Tod Young, said Wednesday he wanted to look at a video of the alleged battery which occurred Aug. 28 at a Gardnerville Ranchos residence where the suspect was staying with her teenage daughter.
Oxley is the ex-wife of murder victim Benjamin Oxley who was shot to death in his home Feb. 21, 2008, as he lay sleeping in bed.
Dawn Oxley's roommate James Matlean, 23, was charged with first-degree murder and is being held in Douglas County Jail without bail. The district attorney's office has said Dawn Oxley is not a suspect in the murder.
She was arrested Aug. 28 after the victim said she struck him several times in the face and body. A witness reportedly videotaped the incident on a cell phone.
Oxley is being held in Douglas County Jail on $7,500 bail.
Senior Judge Steven McMorris set her next appearance in East Fork Justice Court for Sept. 8.
