On 11/3/2022, the Douglas County Board of
Commissioners INTRODUCED the following
ordinance:
ORDINANCE: 2022-1608
TITLE: Ordinance 2022-1608, an Ordinance
enacting a revision and codification of the
general ordinances of Douglas County by
amending Titles 1, 6, 9, 10 and 13 of Douglas
County Code to (1) redesignate certain
vehicle and traffic related criminal “misdemeanors”
as “civil infractions” consistent with
the Assembly Bill 116 enacted in 2021 by
the 81st Session of the Nevada Legislature;
(2) define and establish penalties for civil
infractions, (3) clarify that certain codified
“infractions” constitute “criminal infractions,”
and (4) remove language that is unnecessarily
duplicative of the Nevada Revised
Statutes.
SUMMARY: Ordinance 2022-1608 amends
provisions of the Douglas County Code
(DCC) by redesignating certain vehicle and
traffic related criminal “misdemeanors” as
“civil infractions” consistent with Assembly
Bill 116 enacted in 2021 by the 81st Session
of the Nevada Legislature (AB116). Section
I of Ordinance 2022-1608 amends Title 1 of
DCC to include the definition and penalty for
civil infractions; Sections II, III, and V amend
Titles 6, 9, and 13 of DCC, respectively,
to clarify that certain violations of Douglas
County Code (previously designated as
“infractions”) constitute “criminal infractions.”
Section IV of Ordinance 2022-1608 amends
Title 10 of DCC to (1) provide for penalties
that are consistent with AB116, and (2) remove
provisions and language that unnecessarily
duplicate language from the Nevada
Revised Statutes.
The 2nd Reading of this Ordinance will be
held on 12/1/2022. A copy of this ordinance is
on file in the Clerk’s Office for public review.
