CORRECTED NOTICE OF APPLICATION
FOR APPROVAL OF MARGIN RATES
On February 1, 2023, AmeriGas Propane,
L.P. d/b/a Bi-State Propane (“AmeriGas”) filed
with the Public Utilities Commission of Nevada
(“Commission”) an application, designated
as Docket No. 23-01033 (“Application”), for
approval of its margin rates for the preceding
fiscal year.
This Notice serves only to notify the
public that the Commission has received the
above-referenced filing. It is the responsibility
of interested persons to review the filing and
monitor the proceedings to determine their
desired levels of involvement based on how
this matter may affect their unique situations.
The details provided within this Notice are
for informational purposes only and are not
meant to be an all-inclusive overview of the
filing. The Commission may consider and
adopt alternative proposals not contained
within the filing but which are related to the
subject matter of the filing and supported by
substantial evidence.
AmeriGas filed its Application pursuant to
the Nevada Revised Statutes and the Nevada
Administrative Code (“NAC”) Chapters 703
and 704, including but not limited to NAC
704.536, NAC 704.5364 and NAC 704.5366.
Pursuant to NAC 704.5364(1) and NAC
703.5274, AmeriGas requests that certain
material in the application receive confidential
treatment.
In its Application, AmeriGas seeks approval
of the margin rates it charged during the
preceding fiscal year for each of its Nevada
systems and deviation from the requirements
of NAC 704.5364(2)(b).
Pursuant to NAC 704.5366, the Regulatory
Operations Staff of the Commission
(“Staff”) must file a briefing memorandum
setting forth its recommendations and
determinations regarding the Application on
or before TUESDAY, MAY 2, 2023. Not later
than ten business days after Staff files its
briefing memorandum with the Commission,
AmeriGas or any interested person may
file with the Commission a response to the
briefing memorandum or request a hearing
on the Application, or both. If no request for
a hearing is received by the Commission, the
Commission will dispense with the hearing
and take action upon the Application, unless
the Commission finds that a hearing is necessary
or otherwise required by statute.
Interested and affected persons may file
petitions for leave to intervene pursuant to
NAC 703.578 through 703.600 on or before
TUESDAY, MAY 16, 2023.
A person who wishes to participate as a
commenter may file written comments pursuant
to NAC 703.491. A commenter is not a
party of record and shall not take any action
that only a party of record may take. Pursuant
to NAC 703.500, only parties of record
are entitled to enter an appearance, introduce
relevant evidence, examine and cross-examine
witnesses, make arguments, make and
argue motions and generally participate in the
proceeding.
The Commission is not responsible for
providing clerical or administrative assistance
or materials to parties during Commission
proceedings. If such assistance is necessary,
parties must make other arrangements for
this type of assistance.
