A man who grabbed another inmate by the throat during an altercation was sentenced to 2-5 years in prison on Tuesday.
Anthony Michael Conley, 32, said he apologized to Logan Peetz, who is himself awaiting sentencing for domestic battery with strangulation.
“The irony of the situation is not lost on the state,” prosecutor Jim Sibley said in asking for consecutive sentences.
Conley had been in custody on a warrant for sales of a controlled substance for three months when the altercation occurred in the jail.
“What happened shouldn’t have,” Conley said. Peetz received minor injuries.
Attorney Matthew Ence asked for the sentences to be served at the same time, saying that the difference in their category would result in more time before Conley was released.
District Judge Tod Young thanked Conley for apologizing to Peetz but agreed the two incidents were separate acts and justified one sentence after another.
Conley was given credit for 186 days time served in the drug sales case.
