NOTICE OF AVAILABILITY

FINAL ENVIRONMENTAL ASSESSMENT,

FINDING OF NO SIGNIFICANT IMPACT

AND DECISION RECORD FOR THE

PAINTED ROCK MINE PROJECT

Notice is hereby given that the Department

of the Interior, Bureau of Indian Affairs (BIA),

as lead agency, with the Bureau of Land

Management (BLM) as a cooperating agency,

will be releasing a Final Environmental

Assessment (Final EA) dated July 17, 2024,

for the Painted Rock Mine Project. Based on

the analysis and impacts discussed in the

Final EA and comments received throughout

the public review process, the BIA and

BLM have each prepared a Finding of No

Significant Impact (FONSI) and Decision

Record (DR) for public notice.

The proposed aggregate mine would

be adjacent to Sunrise Pass Road,

approximately 6 miles east of US Highway

395 (2 miles east of the terminus of Johnson

Lane). Knox Excavating Inc. is requesting BIA

approval of a sand and gravel mineral lease

totaling 148.8 acres on an Indian-owned

allotment, and a 0.1-mile (0.8-acre) right-ofway

from a second Indian-owned allotment

for use as the mine entrance. Also being

requested is use (right-of-way) of roads on

BLM-administered public lands that would

make up a 2-mile haul route extending from

the terminus of Johnson Lane to the mine

entrance and a 0.8-mile alternative non-haultruck

route to the south.

The BIA and BLM’s decision to proceed, as

detailed in the DR, can be appealed pursuant

to appeal procedures at 25 CFR Part 2 for

BIA and at 43 CFR Part 4 for BLM. Additional

appeal procedure details are provided in each

agency’s DR.
