The wheelman in a Home Depot heist in which one of a trio of men menaced a store employee with an ax received probation on April 23.
Juan Filipe Tellez-Rico, 21, was not the thief wielding the ax, though he admitted to principal to assault with a deadly weapon.
Tellez-Rico faces 19-48 months in prison should he fail probation.
He is also subject to an immigration hold and could be deported after being convicted of the felony.
According to court documents, Tellez-Rico was one of two men pushing a cart past the theft detectors at the store when they went off on March 9, 2023. An employee who attempted to stop them said a man with an axe threatened him and he let them past. Video showed that wasn't Tellez-Rico.
Tellez-Rico was ordered to pay $2,368 in restitution and $302.45 for the cost of extradition. He was given credit for 171 days time served. He was arrested in California on a warrant out of Nevada on Nov. 6, 2023, after his fingerprints were found associated with the crime.
• A man, who admitted to challenging another inmate to fight, was given credit for time served on the gross misdemeanor.
Jesse Lee Rumminger, 38, agreed to have his probation revoked last month and will serve a 19-48-month prison sentence.
The incident occurred March 9, a week before he was ordered to prison. Rumminger’s Jan. 4 arrest at a north county shopping center with fentanyl prompted deputies to call medics to the scene in case of an exposure.
Rumminger was terminated from Western Nevada Regional Drug Court after he was allowed to participate in August 2021 after an earlier arrest for possession of heroin.
• A man who admitted to one count of felony possession of methamphetamine may seek diversion, though that might be a problem.
Adam Fisk Temple, 52, was arrested Oct. 23, 2023, according to court documents.
His attorney said he was hoping to get diversion, which isn’t unusual for a regular possession case. However, Temple’s criminal record, which includes incarceration on seven felonies over the course of a decade could make him ineligible. The penalty for a felony drug possession is 1-4 years and a $5,000 fine.
Temple told Judge Tod Young he was 185 days clean on April 23.
• A man who failed to turn up for his sentencing last summer is in Douglas County custody.
Curtis Javier Hernandez was scheduled to be sentenced on charges of felony possession of a stolen motor vehicle and methamphetamine.
Attorney Matthew Ence said his client relapsed. He was arrested April 17 on the warrant. He was facing a suspended sentence on the Jan. 17, 2023, felonies.
• A man who brandished a weapon while driving under the influence was granted diversion, though the judge kept him on a tight leash.
Lucas Bishop Abreu, 22, admitted to possession of a firearm by a user of controlled substance and second DUI.
The incident occurred Nov. 7, 2023, according to court documents.
If he fails the diversion, he could face a maximum of six years in prison and a $5,000 fine.
