A Ruhenstroth man admitted a gross misdemeanor charge of child endangerment in connection with a shooting incident last spring.
Chauncey Clayton Fagan, 38, appeared in Douglas County District Court on Tuesday with attorney Maria Pence.
The charge requires Fagan undergo an evaluation before his June 3 sentencing where he faces up to 364 days in jail.
One issue that will have to be settled will be a request for diversion in connection with the May 25, 2024, incident where Fagan was drunk when he pointed a firearm in the direction of a child’s room.
Pence said that Fagan had been taking prescribed opiates for a back injury and that led to some of his behavior.
Douglas County deputies received reports that Fagan, a former Douglas High School math teacher, was under the influence and shooting in the house.
Pence submitted letters from Fagan’s two family members, who the Sheriff’s Office said fled the house as a result of the shooting. She said they didn’t consider themselves victims.
Fagan was under supervision when the shooting incident occurred after he crashed into the community’s cluster box the previous November.
Fagan entered guilty pleas to driving under the influence, failure to report a crash and possession of a firearm by an intoxicated person on March 19 in East Fork Justice Court.
He also agreed to pay $8,235 in restitution for the mailboxes in connection with the collision.
His sentencing Wednesday on a misdemeanor domestic battery case in East Fork Justice Court was delayed until April 16 after prosecutor Jim Sibley filed a memorandum in support of sentencing on Wednesday morning. Pence wanted more time to review the memo with Fagan.
• A woman, who is participating in inpatient treatment, received a suspended 12-30-month sentence for burglary of a business.
Katie Lynn Neil admitted to burglary of a business in connection with a shoplifting theft on Nov. 8, 2024, involving her and another subject.
Neil will also have to pay a $500 fine.
• A man who burglarized two businesses within half a month faces up to 10 years in prison.
Christopher Aaron Wilson, 31, admitted to two counts of burglary Monday.
According to court documents, Wilson entered Best Buy on Topsy Lane on two occasions between Feb. 15 and Feb. 23 and Home Depot on Jacks Valley Road on March 7 with the attempt to burglarize the stores.
Sentencing is scheduled for May 19.
• A woman who pleaded guilty to identity theft on Monday faces up to 20 years in prison.
According to court documents, Kellie Grace Byers, 48, stole identification information from two individuals to obtain player cards.
Sentencing is scheduled for June 2.
